Welcome to Dung Chat. These Terms of Service ("Terms") are a binding agreement between you and DC Entertainment LLC ("Dung Chat", "we", "our", or "us") and govern your use of the Dung Chat mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age required in your country) to use Dung Chat, and you must be able to form a binding contract. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. We age-gate at sign-up and may remove accounts we believe belong to underage users.
You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Provide accurate information, keep it current, and let us know promptly of any unauthorized use. You may hold only one account and may not share it. You can delete your account at any time from the app's Settings.
Dung Chat is a location-based social game in which you discover and "claim" thrones tied to real-world places, earn founder and ruler titles, build streaks and scores, appear on leaderboards, form rivalries with other players, and write reviews of venues. Some features depend on your device's location and on third-party services such as maps. The Service is provided for entertainment.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment. You may not copy, modify, reverse-engineer, resell, or create derivative works of the Service except as permitted by law.
To keep the game fair and the community safe, you agree not to:
You may create content such as throne names, reviews, ratings, reactions, and other submissions ("User Content"). You retain ownership of your User Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it as needed to operate and promote the Service.
You represent that you have the rights to the content you post and that it does not violate these Terms or any law. You agree not to post content that is unlawful, infringing, defamatory, harassing, hateful, sexually explicit, or that depicts the interior of restrooms — the app permits venue-exterior imagery only.
We do not tolerate objectionable content or abusive users. You can report content and block other users in the app. We may review, moderate, remove, or restrict content and may suspend or terminate accounts that violate these Terms, and we will act on reports of objectionable content and abusive behavior. We are not obligated to store or return your User Content.
Dung Chat encourages you to move through the real world. Your safety is your responsibility. Always be aware of your surroundings, obey all laws and signage, respect private property and the rights of others, and never use the app while driving or in any way that puts you or others at risk. Do not enter dangerous, restricted, or private locations to play. To the maximum extent permitted by law, you assume all risks associated with your real-world activity while using the Service.
The Service may include virtual items such as crowns, throne skins, points, titles, and other cosmetics. These have no monetary value, are not your property, and cannot be redeemed for cash or transferred outside the Service. We may modify, regulate, remove, or eliminate virtual items at any time. We do not currently sell virtual items or subscriptions; if we add paid features, additional terms will apply.
The Service, including its software, design, mascot, artwork, logos, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. Except for the license granted to you above, these Terms do not give you any right in our intellectual property. Map data and imagery are provided by third parties and remain their property.
The Service relies on third-party providers, including Google (Firebase and Google Maps/Places) and the Apple App Store and Google Play. Your use of those services is subject to their own terms. We are not responsible for third-party services and do not endorse the venues or places shown in the app.
If you send us suggestions or feedback, you grant us the right to use it without restriction or obligation to you.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate, or that location, rarity, or scoring will be precise.
To the maximum extent permitted by law, Dung Chat and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service — including any injury, loss, or damage arising from your real-world activity. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100) or the amount you paid us in the twelve months before the claim, whichever is greater.
You agree to indemnify and hold harmless Dung Chat from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms, create risk or legal exposure for us, or for any other reason permitted by law. Provisions that by their nature should survive termination (including content licenses you granted, disclaimers, limitations of liability, and indemnification) will survive.
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by other appropriate means and update the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the United States and, where applicable, the state in which we are established, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the courts located in the United States, unless applicable law requires otherwise. Nothing in these Terms limits any rights you may have that cannot be waived under the law of your place of residence.
If you obtained the app from the Apple App Store, you acknowledge that these Terms are between you and Dung Chat only, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
